في سياق متسارع يشهد فيه الوطن حراكًا حقوقيًا وإعلاميًا متناميًا، تبرز قضية متابعة حقوقي وصحفي معروف بنزاهته ومصداقيته بعد تبليغه عن شبهة فساد داخل مستشفى جهوي. هذه المتابعة أثارت جدلاً واسعًا بين زملاء اصدقاء الأوساط الحقوقية والصحفية دون أن يعطي الموافقة على اتخادها مادة دسمة لمواقعهم من خلال ايمان الحقوقي الصحفي بنزاهة قضيته أمام محكمة الاستئناف بادن الله. تعالى، حيث ترى الشبكة الوطنية لحقوق الإنسان أن القضية تكشف عن خلل مسطري واضح في التعامل مع البلاغات والحقوق القانونية للصحفيين الحقوقيين.
الشبكة، عبر بيانها الرسمي، تؤكد دعمها الكامل للحقوقي والصحفي المعني، وتطالب النيابة العامة بمراجعة المساطر ومواجهة الوقائع بما يضمن حماية المصلحة العامة، وصون حرية التعبير، وحق المواطنين في التبليغ عن أي شبهة فساد، دون التعرض للمتبليغ أو التشهير به.
أولاً: جوهر القضية
تؤكد المعطيات المتوفرة أن الحقوقي والصحفي المعني — وهو فاعل جمعوي وصحفي نزيه — استند في منشوره إلى تصريح صادر عن شخصية عمومية داخل مقر جمعية حقوقية قانونية، مزودة بكاميرات مراقبة لحماية المقر وممتلكاته، وهو فضاء مفتوح للجمهور يتوافد عليه المواطنون لطلب الدعم والمؤازرة.
وقد اقتصر المنشور على التبليغ عن شبهة فساد تتعلق بالتوظيف مقابل المنفعة، دون ذكر أي أسماء أو صفات شخصية، مكتفيًا بالدعوة إلى فتح تحقيق قضائي من طرف النيابة العامة المختصة، وقدّم بلاغًا رسميًا إلى السيد وكيل الملك قصد فتح البحث في مضمون التصريحات.
ثانيًا: الخلل الإجرائي
رغم وضوح نية الصحفي الحقوقي في التبليغ عن شبهة الفساد، فقد تم متابعته على أساس تسجيل دون موافقة، رغم أن الواقعة تمت داخل فضاء عمومي مجهز بوسائل المراقبة القانونية، وتحت صفة المنفعة العامة التي تخول للجمعية الحق في توثيق أي زيارة أو تصريح.
وتبين أن الضابطة القضائية لم تقم بـ:
السؤال عن وجود كاميرات داخل المقر.
مواجهة المعنيين بالتصريحات بالأسماء الواردة على لسان الشخصية العمومية.
الاستماع إلى الحقوقي الصحفي حول شكايته الأصلية المرتبطة بشبهة الفساد داخل المستشفى
كما لم يتم تبليغ الحقوقي الصحفي بجلسات المحاكمة، ما يشكل خرقًا لحقوق الدفاع وللمسطرة الجنائية.
ثالثًا: التوصيف القانوني
ما قام به الحقوقي الصحفي يدخل ضمن الواجب المهني والتبليغ عن شبهة فساد، وليس المس بالحياة الخاصة، إذ تم تقديم التسجيل مباشرة للنيابة العامة ولم يُنشر أو يُسرب.
إن متابعة الحقوقي على أساس المادة 447 من القانون الجنائي تعتبر تأويلًا خاطئًا، إذ لم يقم بالمس بأي شخص، ولم يُشر إلى أسماء أو يتهم أحدًا بالتشهير أو القذف.
رابعًا: موقف الشبكة الوطنية لحقوق الإنسان
الشبكة تدعم الحقوقي والصحفي المعني، وتعتبر متابعته مسًّا بحرية التعبير وحق التبليغ عن الفساد.
تطالب النيابة العامة بإعادة فتح البحث التمهيدي ومراجعة عناصر المتابعة وفق المعطيات القانونية الصحيحة.
تشدد على السلمية وضرورة احترام مؤسسات الدولة، مع استمرار كشف مظاهر الفساد ضمن الإطار القانوني.
تضع ثقتها الكاملة في القضاء المغربي المستقل، وتأمل أن محكمة الاستئناف تنصف الحقوقي الصحفي وتعيد الاعتبار لمصداقيته ونزاهته المهنية.
ختام

Contexte
Dans un contexte marqué par une dynamique croissante des mouvements médiatiques et des défenseurs des droits humains, le cas d’un militant et journaliste reconnu pour son intégrité a suscité un large débat. Celui-ci a signalé un cas présumé de corruption dans un hôpital régional.
Malgré sa transparence et sa bonne foi, il fait aujourd’hui l’objet de poursuites, révélant un déséquilibre manifeste dans le traitement des signalements et dans le respect des droits des journalistes et des défenseurs des droits humains.
Le Réseau National des Droits de l’Homme, dans son communiqué officiel, exprime son soutien total au militant concerné et appelle le Parquet à revoir les procédures et à garantir la protection des lanceurs d’alerte, de la liberté d’expression et du droit des citoyens à dénoncer toute suspicion de corruption.
I. Fond de l’affaire
Le militant et journaliste en question, acteur associatif reconnu, s’est appuyé sur une déclaration publique faite par une personnalité lors d’une réunion dans une association légale dotée de caméras de surveillance.
Le lieu étant ouvert au public, le journaliste s’est limité à signaler un soupçon de corruption sans citer de noms, tout en demandant l’ouverture d’une enquête judiciaire par le procureur compétent.
II. Dysfonctionnements procéduraux
Malgré la bonne foi du journaliste, il a été poursuivi pour enregistrement sans consentement, alors que les faits se sont produits dans un espace public équipé de dispositifs légaux de surveillance.
L’enquête policière n’a pas vérifié :
l’existence des caméras de surveillance dans le siège de l’association,
l’identité de la personnalité publique citée,
ni entendu le journaliste sur sa plainte initiale liée à la corruption dans l’hôpital.
En outre, il n’a pas été informé des audiences, constituant une violation de ses droits de défense et de la procédure pénale.
III. Qualification juridique
L’acte du journaliste relève de son devoir professionnel de signaler un acte de corruption et non d’une atteinte à la vie privée.
Le fichier n’a jamais été diffusé publiquement, mais transmis directement au parquet.
L’application de l’article 447 du Code pénal dans ce cas constitue une interprétation erronée de la loi.
IV. Position du Réseau National des Droits de l’Homme
Le Réseau :
soutient le militant et journaliste concerné,
considère que cette poursuite porte atteinte à la liberté d’expression et au droit d’alerte,
appelle le Parquet à rouvrir l’enquête et à rectifier les éléments de la poursuite,
insiste sur la voie pacifique, le respect des institutions de l’État et la lutte légale contre la corruption,
exprime sa pleine confiance dans la justice marocaine indépendante, espérant une décision équitable de la Cour d’appel.
Conclusion
Le Réseau National des Droits de l’Homme réaffirme sa conviction que la justice marocaine saura corriger toute confusion et que le signalement de la corruption est un devoir national et moral, non un crime.
Il appelle les autorités judiciaires à agir avec sagesse et impartialité, pour protéger la dignité du travail journalistique et la crédibilité du mouvement des droits humains au Maroc.

Despite acting in good faith, he now faces prosecution, exposing procedural flaws and raising serious concerns about the protection of whistleblowers and journalists in Morocco.

Moreover, he was not notified of the court hearings, violating his right to defense and due process.
III. Legal Assessment
The journalist’s act falls under his professional and civic duty to report corruption, not an invasion of privacy.
The recording was never published or leaked, but submitted directly to the Prosecutor’s Office.
Applying Article 447 of the Penal Code in this context is a misinterpretation of the law.
IV. Position of the National Human Rights Network
The Network:
expresses its support for the journalist and activist,
denounces the prosecution as a violation of freedom of expression and whistleblower protection,
calls for a reopening of the investigation based on accurate legal grounds,
insists on peaceful advocacy and respect for state institutions,
